The following Terms and Conditions apply as a general framework for all the services you can book from Super India Tour. Kindly note that the term ‘you’ or ‘client’ refers to the user or viewer of our website.

BOOKING:

Once you receive a confirmation that any tour is booked with Super India Tour, you will be bound by a contract with the company. If any deposit amount is required from you by Super India Tour, the contract will take effects as soon as we will have received said amount on our account.

PRICES:

In the case of tour arrangements with a single total price, the prices are calculated according to the tour’s departure date.

In the case of “à la carte” services, the tour prices are based on the stay as a whole, the time it took to the company for planning the trip, the activities and the special requests of the guests.

PAYMENT:

We usually require a deposit of 25-30% from the total tour cost to hold the booking confirmation until your arrival. In some cases Super India Tour might have to require you to pay an additional advance amount before the final balance payment; in this case, you will be informed immediately about the exact payment conditions and deadline, from your Super India Tour contact person. The remaining balance will have to be paid at the beginning of your tour, before it starts.

If the deposit amount is not paid in the required deadline, Super India Tour can, after setting you a short additional deadline, withdraw itself from the agreement without having to pay any indemnity to you. It reserves itself the right to request the payment of a compensation for the costs incurred because of the absence of any advance payment from you.

If our collaborators don’t require any advance deposit, the full amount of the tour will have to be paid at the beginning of your tour, before it starts.

Our clients can proceed to the payment of the tours by the following payment methods:

– by online credit card payments
– by online debit card payments
– by bank transfer
– via platforms such as PayPal, GooglePay and other services as agreed with your Super India Tour contact person.

Any additional cost incurred by the payment by credit card or from your bank/service provider has to borne by you and cannot be deducted or levied from the price set by Super India Tour.

Please keep in mind that no Super India Tour representative will ask you for your credit card number and CVV, password, net banking login or any confidential information. If any of this should ever happen, please report it immediately to [email protected].

CANCELLATION POLICY :

Each tour has its own cancellation policy. The policy of each of them is indicated on every tour description page or will be indicated to you by your Super India Tour contact person.

If no specific cancellation policy is indicated on the tour description you’re planning to book, be aware that any cancellation taking place less than 24 hours in advance will lead to refund 50% of your deposit amount.

In case you don’t show to the appointment location and time as agreed with your Super India Tour contact or if you show up with more than 45 minutes delay, the company will not have to maintain the tour and you will be charged with 100% of the price of the tour you had booked.

In any case, it would be highly appreciated if you communicate to us as soon as possible any modification, change or report you’d like to bring to the tour you’ve booked.

INDEMNITY:

The client agrees to indemnify against all damage or injury (including death) to property or person resulting from intentional, negligent acts or omissions.

LIABILITY:

Super India Tour accepts no responsibility and shall not be liable for any injury, illness, loss, accident, expenses, delay or other irregularity resulting from the client’s participation in any of its services provided (tours, transfers and touring programs). Notably, Super India Tour is not responsible if you or any member of your party suffer death, illness or injury as a result of any failure to perform or improper performance of any part of our contract with you. Liability for ruined holidays, lost holiday joy, frustration, etc. is excluded.

Please note that luggage and personal effects shall be all times and in all circumstances at the owner’s risk. Super India Tour cannot accept responsibility for any loss or damage to your luggage unless it’s been directly caused by the negligence of one of our representatives.

Keep in mind that you are responsible for arranging your own travel insurance, if deemed necessary. Super India Tour does not have any insurance policy covering the expenses for accident, sickness, loss due to theft, or any other reasons. You are therefore advised to purchase such insurance in your home country.

Super India Tour reserves the right to modify tours and itineraries with or without notice; the tour packages are organized in accordance with the respective transport companies, their schedules and itineraries; these are provisional and subject to change.

Super India Tour prices are based on the rates as negotiated by us with the hotels, transport companies, guides etc. Hotels and transport companies retain the right to modify the rates without notice. In case of such change – the rates quoted by us can be changed according to the modifications by the above mentioned service providers.

The itineraries indicated on the tours description pages are sample itineraries, intended to give you a general idea of the trip schedule. Various and multiple factors such as the weather, road conditions, physical ability of the guests may lead to some changes in the itineraries either before or during the tour. Super India Tour can proceed to change some aspects of the itinerary including transportation or/and accommodation if it is in the interest of the trip, of the guests safety or comfort without making any discount or refund. Any extra cost would then be payable by the client.

Acknowledgement and confirmation of the above-mentioned conditions is active once clients participate in one of the provided tours via Super India Tour. The itinerary of the tour cannot be modified without prior permission from Super India Tour.

FORCE MAJEURE

The usual regulations about force majeure events apply to the contracts with Super India Tour.

However, it is specified that Super India Tour shall not be responsible or held liable for any delay or change in the program, itinerary or expenses incurred by loss, injury and damage – directly or indirectly – due to natural hazards, flight cancellations, accident, breakdown of
equipment or transport, weather, sickness, landslides, political closures, acts of God, perils incident to the sea, floods, fire, acts of Government or any other authorities, wars, civil disturbances, riots, theft, pilferage, epidemics, pandemics, quarantines, medical issues, custom regulations, defaults, or any other causes beyond our control or any incidents followed by extra expenses endured by the clients.

VALIDITY, APPLICABLE LAW AND JURISDICTION

If any provision of the above Terms and Conditions shall be declared void, it will have no effect on the validity of the other paragraphs.

The contract concluded between Super India Tour and yourself is subject to Indian law. For any dispute with Super India Tour, the exclusive place of jurisdiction is Agra.
